The drafting of opinions about the compliance of the final proposal of the Spatial Development Plan of a City or Municipality SDPCM with the Spatial Plan of the County SPC

In the process of adopting a spatial development plan of a city, or municipality, with the Physical Planning Act (OG 153/13 and 65/17) the obligation of acquiring the opinions of the Institute is specified in view of the compliance of the final proposal of that plan with the Spatial Plan of Primorje-Gorski Kotar County.

The drafting of opinions about spatial plans directly affects the improvement of the quality of spatial plans and eliminates difficulties during the issuance of local permits and aims at ensuring the respecting of the principles of the vertical integration of spatial plans which is specified by the Act.

The procedure of drafting opinions is a continuous task that requires a great commitment of time and many employees who work with various expert fields. In the process of drafting opinions carried out are the reading of the whole spatial plan, the study and reading of the spatial plan of the wider region, interpretations, discussions and meetings with the municipality/town and the drafter, the writing of notes and memorandums, the inspections of regulations, the acquisition of interpretations etc.

Participation in the procedure of public discussion for the Spatial Development Plan of a City or Municipality SDPCM

Apart from the procedure of giving opinions of the final proposal of the document of physical planning, the Institute also participates in the procedure of public discussion with the delivery of a written observation which contains an evaluation of the compliance with the Spatial Plan of PGC, as well as an evaluation of the compliance with the regulations and rules of the profession. In this way a basic overview of the completed document of the physical planning is made at an earlier phase and therefore making the removal of any possibly identified irregularities easier. According to needs contacts and consultations with municipalities and towns, and individual planning entities from the beginning to the end of the draft of the plan are carried out. This collaboration is valuable to the contribution of the quality of the spatial plan.

Overview of prepared opinions and participation in public discussion in 2021

During 2021, opinions were expressed about the harmonisation of spatial development plans for seven (7) spatial development plans of towns and municipalities, through nine (9) completed overviews. Within the public discussion procedure, seven (7) opinions about spatial development plans and twelve (12) opinions about urban development plans were expressed.

During 2020, opinions were expressed about the harmonisation of spatial development plans for six (6) spatial development plans of towns and municipalities, through twelve (12) completed overviews. Within the public discussion procedure, ten (10) opinions about spatial development plans and sixteen (16) opinions about urban development plans were expressed.

Overview of the prepared opinions and participation in the public debate in 2019

During 2019 within the framework of the public debate procedure, opinions were given about 11 spatial plans of the development for the towns of Bakar, Kraljevica, Vrbovsko, Crikvenica and Rijeka, and about the municipalities of Mošćenička Draga, Malinska-Dubašnica, Lovran, Fužine, Mrkopalj and Baška. In the same way, during this period, opinions were given about the 11 urban development plans, and about the GUP (general urban plan) of the City of Rijeka.

An overview of the drafted opinions and participation in public discussion in 2018

Through the procedure of drafting opinions in 2018. 8 spatial plans of development were evaluated through 9 overviews  (for the municipalities of  Brod Moravice, Baška, Punat, Malinska-Dubašnica, Jelenje, Matulji, Vrbnik i Mošćenička Draga). In 2018. also 4 urban development plans were evaluated. 

During 2018 the Institute participated in the procedures of public discussions for 5 spatial plans of development of municipalities (Punat, Mošćenička Draga, Malinska-Dubašnica, Matulji i Ravna Gora.)

An overview of the drafted opinions and participation in public discussion in 2017

In 2017 during the procedure of the drafting of opinions 8 spatial plans of development (for the municipalities of Omišalj, Kostrena, Jelenje and Lokve, and the towns of Rijeka, Kraljevica and Bakar and Novi Vinodolski), were evaluated through 10 overviews.

During 2017 the Institute participated in the procedures of public discussions for 6 spatial plans of development of municipalities, in other words, towns (Lokve, Rijeka, Baška, Novi Vinodolski, Mošćenička Draga, Brod Moravice).

Overview of the drafted opinions and participation in public discussion in 2016

Through the procedure of drafting opinions in 2016 10 spatial plans of development (for the municipalities of Vrbnik, Ravna Gora, Baška, Klana, Jelenje, Matulji, Malinska Dubašnica and the towns of Crikvenica, Bakar and Mali Lošinj), were evaluated through 17 overviews.
During 2016 12 urban development plans were considered and opinions of them were issued via 17 drafted opinions, and during 2017 the influx of such UDP was significantly reduced (only 1), which points to the fact that the processes of the draft and the adoption of UDP begun by the “old” Act are almost fully completed.*

During 2016 the Institute participated in the procedures of public discussions of 5 spatial plans of development (Baška, Klana, Dobrinj, Omišalj and Kostrena), and of 2 urban spatial plans of development (Kastav and Rijeka).

* With the Physical Planning Act the detailed development plan and obligation of acquiring the opinions of the Institute of the urban development plan (UDP) was revoked. However, in line with the transitional and final provisions of the same Act, the Institute was obliged to draft opinions of the implementation plans whose drafting was begun under the Physical Planning and Building Act. In line with the mentioned the Institute continued with the drafting of opinions about the compliance of the implementation plans of the local government with the Spatial Plan of Primorje-Gorski Kotar County and the spatial plans of the neighbouring counties and with other documents of the physical planning of the effects on the physical plan for which the opinion was drafted.
